Welcome to MyFMLA.com, a telemedicine platform offering online services for FMLA (Family and Medical Leave Act) certification, short-term disability application certification, and ADA (Americans with Disabilities Act) certification. By using our services, you agree to the following Terms of Service. Please read them carefully before proceeding.

1. Services Provided

Our platform offers the following services to employees who need documentation for workplace leave:

  • FMLA Leave Certification: We provide medical certification for FMLA leave in accordance with federal regulations, enabling employees to take time off from work for qualifying medical reasons.
  • Short-Term Disability Application Certification: We offer certification for short-term disability benefits to support employees in their claims for short-term leave due to illness or injury.
  • ADA Certification: We provide certification for Americans with Disabilities Act (ADA) accommodations for employees who need adjustments or accommodations in the workplace due to medical conditions.
  • Consultation with Licensed Physicians: All certifications require a 15-minute video consultation with a licensed and board-certified physician. During the consultation, the doctor will assess your condition and determine the need for the requested certification.
  • Form Completion within 3 Business Days (72 Hours): After the consultation, we aim to complete and provide the required forms within 3 business days (72 hours).
  • Same-Day Certification Available: In certain cases, we are able to offer same-day certification. Please inquire for availability and conditions.
  • 24/7 Access to Secure Portal: You will have 24/7 access to our secure online portal where you can track your request, communicate with support staff, and view or download your completed certifications.
  • Support Staff Assistance: Our team of professional support staff is available to assist you throughout the process, ensuring a smooth and timely experience.

2. How the Process Works

  1. Book Your Video Visit: To begin the process, you must book a 15-minute video visit on our platform with one of our Board-Certified physicians, providing the necessary information for identification and billing.
  2. Complete the Form: Following your booking, you will be sent an intake form to your email to complete before the video appointment. This provides the necessary information for the physician to review before the appointment.
  3. Create an Account: Once you have submitted the intake form, you will receive an email invitation to register and login in to our secure portal.
  4. Attend the Video Appointment: During the consultation, the physician will review your medical condition and discuss your need for FMLA, short-term disability, or ADA certification.
  5. Receive Your Certification: Following your consultation, the physician will complete the necessary certification forms based on their evaluation and provide you with the required documentation. This process will be completed within 3 business days (72 hours) or same day, depending on the urgency and availability. Once your certification is complete, it will be uploaded to your secure portal for you to access, download, or share with your employer as needed.

3. Payment and Insurance Policy

  • Our platform operates on a self-pay basis and does not accept insurance. All services must be paid for at the time of booking the consultation or service.
  • Payment can be made securely via the payment methods provided on our platform.

4. Availability and Hours of Operation

  • 24/7 Portal Access: You can access your account and view progress at any time via our secure portal.
  • Video Consultations: Our physicians are available for video consultations during normal business hours, Sunday through Friday.

5. Your Responsibilities

  • Provide Accurate Information: You are responsible for providing accurate information regarding your medical condition during your consultation. Failure to provide accurate or complete information may affect the outcome of your certification request.
  • Eligibility: You must meet the necessary eligibility criteria for FMLA, short-term disability, or ADA certification. For FMLA, this typically involves having a qualifying medical condition that prevents you from performing your job duties.
  • Follow-Up: If your employer requires additional documentation or clarification, you may be asked to provide further information or schedule a follow-up consultation.

6. Privacy and Confidentiality

  • We take your privacy seriously. All medical information shared through our platform is protected in accordance with applicable privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA).
  • All consultations, records, and forms are stored securely in our encrypted platform, accessible only by authorized individuals.

7. Cancellations and Refunds

  • Cancellations: If you need to cancel your consultation, please do so at least 24 hours in advance to avoid being charged. Cancellations made within 24 hours of the scheduled consultation may not be eligible for a refund.
  • Refunds: Refunds will be provided only in the case of a technical error or failure to deliver the service within the promised time frame. Refunds are issued at the discretion of com services.

8. Limitations of Service

  • Non-Emergency Use Only: Our services are intended for non-emergency medical certifications. If you are experiencing a medical emergency, please seek immediate care by calling 911 or visiting the nearest emergency room.
  • Eligibility for Certification: The physician’s decision on whether you qualify for FMLA, short-term disability, or ADA certification is based on the information you provide during the consultation. Certifications are issued at the discretion of the physician and subject to medical evaluation.

9. Indemnification and Limitation of Liability

  • By using our platform, you agree to indemnify and hold harmless MyFMLA.com and its affiliates from any claims, damages, or liabilities resulting from your use of our platform or services.
  • We are not liable for any delays or failures in service due to factors beyond our control, including but not limited to, technical issues, system outages, or incomplete information provided by users.

10. Termination of Service

  • We reserve the right to suspend or terminate your access to our platform at any time if you violate these Terms of Service or if your behavior is deemed inappropriate or disruptive.

11. Changes to Terms of Service

  • We may update these Terms of Service at any time. Changes will be posted on this page, and the updated terms will be effective as of the date of posting. You are responsible for reviewing these terms periodically.
