What is FMLA?

FMLA stands for the Family and Medical Leave Act, a federal law in the United States that provides eligible employees with job-protected leave for certain family and medical reasons. Here’s what you need to know about FMLA:

Purpose: FMLA allows employees to take unpaid leave for specific family and medical reasons without the risk of losing their job or health insurance coverage.

Eligibility: To qualify for FMLA, employees must meet these criteria:

  • Work for a covered employer (typically private employers with 50 or more employees, or public agencies).
  • Have worked for the employer for at least 12 months (not necessarily consecutive).
  • Have worked a minimum number of hours in the last 12 months.

Reasons for Leave:

FMLA leave can be used for:

  • Birth and care of a newborn child.
  • Adoption or foster care placement of a child.
  • Care for a spouse, child, or parent with a serious health condition.
  • The employee’s own serious health condition that prevents them

Duration: Eligible employees can take up to 12 consecutive weeks of unpaid leave in a 12-month period for continuous FMLA or up to 60 days (480 hours) of unpaid leave in a 12 month period for intermittent FMLA. In certain cases, such as military caregiver leave, this can be extended to 26 weeks.

Job Protection: During FMLA leave, the employer must continue the employee’s health insurance coverage as if they were still working. After returning from leave, employees will have the right to return to the same position or an equivalent job.

Types of FMLA Leave

The FMLA offers three types of leave arrangements to accommodate the varied needs of employees dealing with mental health challenges.

Continuous Leave

Continuous FMLA leave refers to taking a single block of time off from work for a serious health condition, without interruption, to recover or receive treatment. This type of leave is typically used for conditions that require an extended period of time away from work. Serious health conditions that qualify for continuous FMLA leave include mental health disorders and other chronic medical conditions, which significantly impact the ability to perform daily tasks or work duties. To qualify, the condition must involve inpatient care or continuous treatment by a healthcare provider, and employees must provide medical certification to confirm the need for leave.

Intermittent Leave

Intermittent FMLA leave allows employees to take time off in small, non-consecutive increments, such as hours or days, for a serious health condition that requires periodic treatment or flare-ups. This type of leave is ideal for conditions that don’t require continuous leave but still affect an employee’s ability to work, such as ongoing medical treatments, regular doctor visits, or when symptoms of a chronic illness or mental health disorder  intermittently worsen. Intermittent FMLA leave can be used as needed to manage these conditions, allowing employees to balance work responsibilities with their health needs, provided they have medical certification to support the necessity for such leave. 

Reduced Schedule Leave

A reduced schedule under FMLA allows employees to work fewer hours than their usual schedule to accommodate a serious health condition that requires ongoing treatment or recovery. This type of leave is ideal for employees who are able to work but need to adjust their hours to manage their condition, such as attending medical appointments, undergoing treatments, or dealing with the fluctuating symptoms of a chronic illness or mental health disorder. With medical certification, employees can temporarily reduce their work hours without fear of losing their job, providing flexibility to manage their health while still fulfilling work responsibilities.

How Does This FMLA Service Work?

Determine Your Eligibility

Before proceeding, both you and your employer must meet the eligibility criteria for FMLA certification. You can review the full eligibility requirements on the Department of Labor FMLA website

Book a Video Visit

The first step is to schedule a video consultation with one of our HealthSource Medical Associates physicians. We offer video appointments every day of the week, except Thursdays and Saturdays. The cost to secure your appointmen

Complete the FMLA Certification Request Form

After booking your video appointment, you’ll receive an email with a link to our FMLA certification request form. Once completed, you will be invited to our secure portal.

Attend Your Video Appointment

A video consultation is required for us to process your FMLA certification. We’ll send appointment reminders to your email and phone. Please note: if you miss your appointment, a $50.00 no-show fee will be charged.

Receive Your FMLA Certification

If approved, your FMLA certification will be available in your secure portal within 3 days of your video visit. After the consultation, we’ll send an invoice for the remaining balance of our FMLA certification service.

All extensions, recertifications, or requests for updates on status, including physician visit notes, will require a follow-up visit.
